Welcome to DesignSups! These Terms and Conditions (“Terms,” “Agreement”) govern your access to and use of the DesignSups website (designsups.com) and the services we provide (“Services”). By using our website and subscribing to our Services, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree to these Terms, please do not use our Services.
1. Services Provided
DesignSups offers unlimited graphic design services on a subscription basis. By subscribing, you gain access to submit an unlimited number of design requests, which are handled one at a time. We aim to deliver high-quality designs in a timely manner based on your specifications and feedback.
1.1. Service Limitations
While we provide unlimited design revisions and requests, we:
- Work on one request at a time: Once one design is completed, the next request will begin.
- Do not offer real-time design services: Our typical turnaround for most requests is 1-2 business days.
- Do not guarantee specific results: We strive for quality and satisfaction but cannot guarantee that every design will meet subjective expectations on the first draft.
2. Subscription Plans & Payment Terms
2.1. Subscription
When you sign up for DesignSups, you are subscribing to one of our monthly or annual plans:
- Startup Plan: $1,500/month
- Growth Plan: $3,000/month
- Agency Plan: $5,000/month
Each plan provides unlimited design requests and revisions based on the terms outlined for that plan. Payments are charged upfront on a recurring basis (either monthly or annually, depending on your selection).
2.2. Payment Methods
We accept payments through valid credit or debit cards. By providing payment information, you authorize DesignSups to charge the provided payment method for your subscription fees.
2.3. Auto-Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You may cancel your subscription at any time through your account dashboard. Upon cancellation, your access to design services will remain active until the end of the current billing period.
2.4. Payment Failure
If we are unable to process your payment (due to an expired card, insufficient funds, or other reasons), you will be notified. We may suspend your access to our Services until the outstanding payment is successfully processed. DesignSups is not responsible for any fees or charges incurred by failed payments.
3.1. No Refunds After 24 Hours
After the first 24 hours from the time of purchase or renewal, no refunds will be issued, except in cases where we are unable to fulfill the Services as described. This includes refunds for any unused portion of the subscription period.
4. Client Responsibilities
4.1. Providing Accurate Information
You agree to provide clear, detailed instructions for each design request. DesignSups is not responsible for errors or unsatisfactory results due to vague or incomplete information.
4.2. Timely Feedback
Your dedicated designer works on your project based on the feedback and instructions provided. To ensure efficient turnaround times, we require timely feedback. Delays in providing feedback may result in delays in project completion.
4.3. Proper Use of Services
You agree not to use DesignSups for any unlawful or unethical activities, including but not limited to:
- Creating materials that infringe on the intellectual property rights of others.
- Requesting offensive, harmful, or defamatory designs.
- Misrepresenting the source or ownership of design materials.
5. Intellectual Property
5.1. Ownership of Designs
Once you have paid in full for the Services, all completed design files and materials become your property. You are granted full ownership and rights to use the designs as you see fit.
5.2. DesignSups Rights
DesignSups retains the right to use any completed designs in its portfolio for promotional purposes unless otherwise requested by the client in writing.
5.3. Third-Party Assets
If you request the use of third-party assets (e.g., stock images, fonts), you are responsible for obtaining the proper licenses for these assets. DesignSups is not liable for any copyright or licensing violations related to third-party materials.
6. Limitation of Liability
DesignSups is not liable for:
- Any direct, indirect, incidental, or consequential damages arising from the use or inability to use our Services.
- Delays or disruptions in service due to circumstances beyond our control (e.g., internet outages, natural disasters).
- Errors resulting from inaccurate or incomplete information provided by the client.
Our total liability, in any case, shall not exceed the total amount paid by you to DesignSups in the 3 months preceding the event that gave rise to the claim.
7. Termination of Services
7.1. Client Termination
You may cancel your subscription at any time through your account dashboard. Upon cancellation, you will retain access to our Services until the end of your current billing period. No prorated refunds will be provided for partial use of services.
7.2. DesignSups Termination
We reserve the right to terminate or suspend your access to our Services without notice if we believe you have violated these Terms, engaged in unlawful activity, or misused our Services.
8. Confidentiality
Both parties agree to maintain the confidentiality of any non-public information shared during the course of our relationship. This includes but is not limited to business strategies, proprietary designs, and personal client data.
We will not share your personal or business information with third parties, except as required to provide Services or comply with legal obligations.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law principles. Any legal action or dispute arising under this Agreement shall be resolved exclusively in the courts located in [Insert Jurisdiction].
10. Amendments
